A Court of Inquiry (CoI) has been instituted at Chandigarh’s Air Force Station against a Wing Commander for repeatedly raping and “stealing the love and affection” of his colleague’s wife.
The inquiry was instituted after a Lieutenant Colonel, who did not wish to be named, complained that 39-year-old Wing Commander Akshay Phadke sexually exploited his wife and tried to benefit from his marital discord by misguiding her that the marriage was over.
As per the complainant, his wife first came in contact with Phadke’s kin in United Kingdom in 2005. After he was posted to Army Headquarters in Delhi, she also joined him but soon their marriage hit a rock. In July 2009, the Lieutenant Colonel moved to Congo leaving his wife behind. In the meantime, Phadke also moved to Delhi and became a neighbour of his wife.
In the complaint submitted to Air Officer In-Charge Administration, Air Marshal JN Burma, in January this year the Lieutenant Colonel writes, Phadke got the mobile number of his wife and started chatting with her. Soon he tried to capitalise on the their marital discord and allegedly raped her. He also complained that Phadke’s father who is a senior officer in Air Force also threatened him with dire consequences when he protested against Wing Commander’s action.
The CoI was initiated by an order dated February 7 and comprises Group Captain Biji Philip as the Presiding Officer and Wing Commander Vineet Lamba, as a member.
Phadke later approached the Chandigarh Bench of Armed Forces Tribunal (AFT) against the CoI, but it refused to intervene into the matter.
In his defence, Phadke claimed that the charges of repeated rapes in the November of 2009 were never reported to the local police for 16 months.
He added that such offences should be investigated by the local police, which is the appropriate authority, and the case be tried in Delhi courts.

Armed forces are the most corrupted and exploited place…in the name of secrecy and discipline the whole lot are just looting the country…the quality of leadership in the forces is just outdated…just like the leadership in parliament…thiefs!!!!!

These things are rampant in the Forces. Its no surprise. I know at least 3 Admirals, 2 Air Marshals and 6 Generals who have exploited women

in this society all used to take advantage /make rapes , a few only leave in high morale background .And this personnel will be treated as less in officer like quality (OLQ) .in mess parties light off systems are for this purpose only .In mess more than 12 years age boys are not permitted but girls can go for party .Young ladies (newly married ladies )will be giving the welcoming /escorting the VVIP’s of the Armed forces .
It is a short cut for the husbands to get the promotions.

offence is offence , it is to be be trailed by the Indian court asp er the IPC under section 376 and Wg cdr should get respect of his rank and lady must get the her due .someone is done crime should get punishment and being a military officer in higher hierarchy should exemplary for others and it will be lesson for all the culprits .And being Indian we respect the ladies so offender should get his result .And if he is found guilty he should sent to home after the cashiering of his rank without any financial benefits .

I’M ALSO A SERVING MEMBER IN THE AIR FORCE. THE FACT IS THAT WE ARE STILL 90% PART OF THE ROYAL AIR FORCE. SO THE SO CALLED WESTERN TRADITIONS AND CUSTOMS ARE IMPOSED UPON JUNIOR LOTS BY THE HIGHER RANKS FOR THEIR BENEFITS.INCIDENTS SIMILAR TO THE ONE MENTIONED IN THE ARTICLE HAPPEN VERY FREQUENTLY.BUT MANY GO UNNOTICED.MANY SUCH INCIDENTS ARE SUCH THAT THEY CAN NOT BE EVEN TOLD IN FRONT OF A CIVILIZED SOCIETY. THE SO CALLED AFWWA AND LADIES CLUBS ARE ACTUALLY A SCREEN FOR HIDING ALL THESE NONSENSES
Sure, the AWWA/NWWA / AFWWA are not only screens to hide but also a plate form to these illegal activities of such nature. There are numerous cases which can not be elaborated infront of civilised society.
Sorry to differ here.It can not be generalised like this. I dont believe that this comment is written by some one from the officer community of Air Force. Coming back to the post,it is true that the WgCdr took advantage of the lonely lady and had intimacy with her. We cant call it rape.The Col should have allowed her to marry him or even forced the WgCdr,at gunpoint,to marry her ! Instead the wimp went around complaining to all and sundry like a school boy would complain to the teacher about a bully in the class !

This is not merely an article or post or someone’s personal opinion but it is news. You mean such consenual sexual relationships are part & parcel of Armed Forces culture and should go unpunished ??
The so called consensual relation becomes rape when it is consented under duress and also infidlity when status of woman married to someone else exists. So what is big fuss about it….

in Indian society is to be obeyed by the IPC , If any armed forces employee done a rape to one civilian (w/o any armed forces member /servant etc ) to be dealt with IPC 376 only, and it is a non bailable offence .No government employee is having privilege over any civilians .
And he violated about the Good order and discipline of the Air force, sec-65 , so he to be trailed by two charge sheets .
Such articles are in bad taste, clearly the whole episode is being reported one sided. why is the name of the complainant or his wife being with held. Some one is trying to capitalize on a consensual sexual relation between two adults.

it is eye opener for us about the our armed forces,which is run by poor mans taxes , as theory all culprit to be brought into books and if it is done by normal village “gooda” , we can give normal punishments by IPC 376, but those who are uniformed personnel he should be tried by example models , by IPC 376, etc and followed by cashiering of rank by armed forces .
we are giving treatment to crime not to the individuals .then only the crime can brought down .
it is not the mater taste good or bad , here it is point is No:1,rape is done or not , No2, with her concern, no ;3 ,, her husband is suspecting adultery and he is having complaint ,no: 4 is is this effecting the good order and discipline of the Armed forces ,
Almost like this cases are without the concerns of male and female can’t happen . and sending message telephone all just change the sim cards number can kill the issue ,but here some one is emotionally attached we cant do anything .
